Photo Submission


1. Eligibility; Disqualification

Thank you for sharing your stories to support Ocean Conservancy’s efforts in raising awareness and engagement regarding the Florida Red Tide issue. By submitting your stories, including corresponding text, photograph, video footage, and audio recording files (collectively “Content”) to Ocean Conservancy, you agree to these Terms and Conditions. If you are 18 years old or younger, you may participate with the permission and assistance of your parent(s) or guardian(s).

You do not need to be a member of Ocean Conservancy to participate. Each submission must be labeled with the name of the author of the Content. For submissions containing photograph, video footage, and audio recording files, please identify the name of the photographer/filmmaker/audio-recorder, the name of the photograph/video/audio, date and location of the subject, and must be your original work or the original work of the identified author.

Ocean Conservancy reserves the right in its sole discretion to disqualify and eliminate any submission for any reason, including but not limited to, because the submission does not comply with these Terms and Conditions.

3. Subject Matter

The subject matter of the Content submission must pertain directly to the category submitted. All submissions of photograph, video footage, and audio files should be taken in a natural setting. Shots of aquariums, pools or other captive locations will not be accepted. Photographs and video footages of divers touching or stressing marine wildlife will not be accepted.

4. Intellectual Property

Ownership and copyright of all submissions remain solely with the author of the Content or the proprietary owner of the Content. By submitting the Content, you hereby grant Ocean Conservancy and its affiliates, subsidiaries, licensees, and assigns an irrevocable, perpetual, and royalty-free right to use, reproduce, edit, display, transmit, prepare derivative works of, modify, publish and otherwise make use of the submitted Content. These rights include, but are not limited to, the right to modify, censor, compress, edit, affix logos to, and to otherwise alter or make use of the submitted Content.

You further agree that Ocean Conservancy shall have no obligation to post, display, or otherwise make publicly available the submission, and may, in its sole discretion, remove or delete the submission from Ocean Conservancy’s website, social media platform, or in other published locations.

5. How to Submit

To submit, upload your Content and answer the questions about you and your photo(s)/video footage(s)/audio recording(s) as directed. Responses to the questionnaire must be in English. You may submit as many stories as you would like.

Any submission will be deemed ineligible if it is illegible, incomplete, fails to meet the required specifications, or for any other reason at the sole discretion of Ocean Conservancy. If your submission is rejected, it will be removed from the website.

6. Warranty & Indemnification

(A) By submitting Content to Ocean Conservancy, you warrant that your submission is original, that you are the sole owner and copyright holder of your submission (or have obtained the rights to submit Content on behalf of the copyright holder), and that you have not granted exclusive rights to all or part of your submission to any other person or entity. You also warrant that your submission does not violate the right of privacy of any individual; does not infringe any third party proprietary rights; does not infringe any trademark, trade name, trade secret, intellectual property right, or other common law or statutory right; nor does it contain any material that might be deemed offensive or obscene, or that otherwise violates any criminal prohibition or the personal or proprietary rights of any person or entity.

(B) You agree to indemnify and hold harmless Ocean Conservancy, including its directors, officers, employees, members, and agents from and against any and all claims, damages, fees, judgments, costs and expenses, including reasonable attorneys’ fees (referred as “Claims”) that Ocean Conservancy may suffer or incur arising out of or in connection with your breach of warranty set forth under Article 6(A) of these Terms and Conditions.

7. Comments on Entries

All comments posted on entries within the website must adhere to the official commenting policy. Violation of this policy may result in removal of comments, termination of accounts, and/or disqualification from submission.

8. Submission Constitutes Agreement

By submitting Content to Ocean Conservancy, you agree to be bound to and abide by these Terms and Conditions. These Terms and Conditions form a binding legal agreement between you and Ocean Conservancy. By submitting Content to Ocean Conservancy, you consent to have the submitted Content publicly displayed on Ocean Conservancy’s website and social media platforms, as well as published in Ocean Conservancy’s promotional materials.

By submitting, you agree that these Terms and Conditions are governed by the laws of the District of Columbia.
